新媒体传播改变了体育赛事节目的传播过程和呈现形式,引发了赛事主办者、传统电视媒体和新媒体传播之间的利益失衡。美国联邦最高法院2014年6月审结的Aereo案,确立了认定新媒体服务提供商著作权侵权责任的“类似有线电视”标准和“整体情形”标准,改变了著作权内容的分配模式,协调了三者的利益冲突。我国应将体育赛事节目纳入著作权作品保护范畴,实践中认定新媒体服务提供商著作权侵权时,不应局限于新型传播媒体的技术细节,更应注重考察传播行为整体的特点和效果;赛事节目出口美国时,应注意考察和运用美国著作权规则,实现利益保护的最大化。
The new media has changed the communication process and the form of the sports events, caused the interests imbalance among the organizer of the event, the traditional TV media and new media communication. Federal Supreme Court of the United States in June 2014 concluded Aereo case, and identified new media service provider copyright infringement liability of the similar to cable standards and the standards of overall situation, changed the pattern of distribution of copyright content and harmonize the conflicts of interest. China should include the sports programming in the copyright protection of works of category, identify new media service provider copyright infringement in practice not to be limited to the technical details of the new media, more focus on the investigation of the propagation behavior of the overall characteristics and effects ; when events are exported to America, we should pay attention to study and use of the United States copyright rules, in order to achieve maximum protection of the interests.
