研究目的:分析美国新泽西州土地发展权转移银行运作模式,为中国城乡建设用地增减挂钩政策提供参考。研究方法:文献归纳法和比较分析法。研究结果:新泽西州土地发展权转移银行均是为了推动土地发展权转移计划而依法设立、由董事会负责运行管理,具备行政管理和市场参与两大职能,但区域性和地方性的银行在发挥具体职能时各有特点。研究结论:可借鉴新泽西州的经验并结合中国的制度环境,构建适应于跨行政区域土地发展权转移的交易中介机构体系;严格规范政府主导型交易中介机构的行为;发挥交易中介机构教育宣传功能;强调多方共同参与,保护弱势群体利益。
The purpose of this study is to provide reference for the policy of construction land readjustment between urban and rural areas in China by analyzing the operation mode of banking system for land development rights transfer in New Jersey State of the USA. The documentation and comparative analysis are used in the paper. The result reveals the establishment and function of the banking system. The paper concludes that there are four advantages of the New Jersey TDR banking mode that could be the references for Chinese land-policy maker, which are(1)a bank system fitting for both municipal and regional TDR,(2)the strict limitation on the behavior of governmental agencies, (3)the function of education and promotion,(4)the participation mechanism and paying attention to the interests of weak groups.
