采用文献资料法、对比分析等研究方法,对中美两国特殊体育教育法律制度进行比较。认为:国内特殊体育教育法主要来源于制定法,美国特殊体育教育法主要来源于制定法和判例法。两国在特殊体育教育立法进程、服务对象、法律理念、立法模式、实施措施等方面均存在一定的差异。我国特殊体育教育法律理念落后、残障学生的体育教育权利较为模糊、特殊体育教育法律体系不够健全。提出我国应树立"以人为本"的立法理念,明确残障学生的体育权利、健全特殊体育教育法律体系、增强法律的权威性和可操作性等对策。
By using the research methods of literature review and comparative analysis,this paper makes comparison on the legal system of special physical education between China and USA.The results show that the special physical education law in China mainly originates from statutory law,while the special physical education law in USA comes from both statutory and case law.There are considerable differences in the legislative process of special physical education,service object,legal concept,legislative mode and implementation measures between the two countries.It is also pointed out that there are also some problems,such as outdated legal concept of special physical education law,ambiguous definition of the physical education rights for disabled students and imperfect legal system on special physical education,in China.It is suggested that we should establish a people-oriented legislation concept,clarify the physical education right for disabled students,improve the legal system of special physical education and enhance the authority of the law and practical operation in China.
