我国持续发生的雾霾天气引发了社会各阶层关于如何应对城市环境恶化的讨论。在城市环境恶化法律治理模式的对比性分析中发现,科技法律治理城市环境恶化是可行的,但当下在立法价值取向、执法治理模式及守法意识三个方面存在关键性障碍。为此,应在依法治理的过程中,采用＂他律—自律—规范＂的＂三层进阶式＂思维进路,依次通过注重制裁性科技法律规范、科技政策法律化和建立科技法律行为范式等法治路径,最终建立起我国城市环境恶化的科技法律治理机制。

英文摘要：

China＇s ongoing hazy weather has caused the discussion of all orders of society about how to deal with the deterioration of urban environment. Scientific and technological law governing the deterioration of urban environment is feasible in the comparative analysis with the governance of environmental law,but there are critical barriers in three aspects of legislative value orientation,law enforcement＇s mode and law- abiding consciousness today. Therefore,we should adopt the train of thought about ＂ three layers of advanced＂ of ＂ heteronomy,self- discipline,standardization＂ in the process of legal governance,and establish ultimately our country＇s mechanism of legal governance to the deteriorating of urban environment by the path to rule of law about focusing on punitive legal norm of science and technology,legalization of scientific and technological policy,and establishment of behavioral paradigm of scientific and technological law in order.
