作为国家治理(或政府治理)的一种新方式或新机制,合约制推动了国家治理方式从单向依赖走向双向互动、从行政指令走向契约合作,适应了我国激发市场活力、调动社会创造力的改革发展需要。可以围绕合约制如何在交易成本、有限理性、技术水平和社会规范等多重约束条件的影响下达成委托方和代理方的激励兼容等方面进行研究,形成一个有别于哲学、政治学、法学、经济学视角的公共部门管理的合约制理论,并对合约制的有效性进行检验,梳理合约制在当代国家治理中的实践方式和应用路径,为公共部门推广应用合约制提供有益的理论指导和对策建议。
Governing by contract, as a new approach or mechanism of national governance, promotes the evolution of the governing means from one-way dependence to two-way interaction and from administrative instruction to contract-based cooperation, thus invigorating both markets and social creativity in China's reform and development process. It's advisable that research on governance by contract center around how contract practice, subject to multiple constraints such as transac- tion cost, bounded rationality, technical levels and social norms, achieves incentives and compatibility between the con- signer and the agent. Derived from public-sector management, it's different from the perspectives of philosophy, political science, law and economics. The validation and application of governance by contract in contemporary sate governance should be tested and refined, in order to provide the government with viable theoretical guidance and suggestions to encour- age contract practice in the public sector.
