为探究影响农村经济发展的土地确权中的土地纠纷问题,按照跨案例研究方法,构建农村土地确权中土地纠纷成因概念模型,其中土地确权纠纷成因主要包括土地升值、历史权属不清、农民自身和政府四方面。研究结果表明:政府和土地升值成因是造成土地纠纷的主要因素,历史权属不清成因是客观因素,而农民自身成因是主观因素。应通过合理引导农民对土地升值的预期,厘清协调农村土地历史权属,加强农村土地确权工作宣传,规范提升农村土地确权行政管控效能等方面来有效解决农村土地确权中土地纠纷问题。
In order to explore the reasons why the land disputes affect rural economic development, this paper has established conceptual model of land dispute causes involved in the confirmation of rural land rights according to the method of cross case-study. It argues that the reasons behind the disputes of land rights lie in the fact that: appreciation of land; the history of the ownership is not clear; the farmer's issues; and finally, the government doesn't exercise effective leadership. This study result shows that government and land appreciation are the main factors for land disputes; and unclear historical land ownership is objective factors; while the farmer's problem is subjective factors. In response to this, we should reasonably guide the farmers to expect the appreciation of land, clarify and coordinate the rural land historical ownership. At the same time, we should step up our publicity initiatives for rural land rights, and standardize and boost the efficacy of administrative controls over rural land rights.
