法官遴选是司法改革的初始与核心阶段。只有通过严格的遴选程序才能选拔德才兼备、综合素质高的法律精英人才进入法官队伍。法官遴选的过程较为复杂,存在较大的权力腐败空间,有必要引进法官遴选权力清单制度。所谓法官遴选权力清单制度,是指将法官遴选过程中各权力主体的具体职权、行使依据、运行流程、对应的责任,在行使过程中的廉政风险、廉政责任以及法官遴选的流程等明确列示出来,向社会公布,接受社会监督的制度。该制度可以从法官遴选权力与责任清单、遴选腐败风险提示单与明晰法官遴选流程三方面予以建立。

As the commence and core of judicial reform,judge selection could capably feed judge community with virtuous and comprehensively-competent elites only by adopting rigorous selection processes.A power list system for the selection is necessitated because of the complexity of selection process and great potential for corruption.A power list system is one which involves both the publicity of official powers and the accordance for exercising,responsibilities and the process,and supervising the risks and responsibilities for honesty.Such a system in a broad sense could be established based on three sub-systems,i.e.,power and responsibility lists for judge selection,lists of risk indicators for corruption and clarity of judge selection processes.
