通过文献法和归纳法,得出我国目前政策制定者和研究者比较关注的四种征地补偿标准创新。这些补偿标准创新旨在解决传统征地补偿标准存在的补偿标准低、同地不同价、行政干预和被征地农民合法权益难以保证等问题。但是实践和研究表明,四种补偿标准创新各自都存在着一定问题:区分公益性与经营性用地,实行有差别的补偿标准的问题在于难以解决的前提问题,即如何区分公益性与经营性用地;综合区片地价及统一年产值补偿标准的问题在于其测算基础还是产值倍数法,总的来说,它们只是征地补偿改革的一种过渡形式;分享项目效益的征地补偿标准的问题在于应用范围的局限性、初始资本金设置和决策参与问题;市场化的征地补偿标准受到各种农村土地市场环境的限制。
Through a review of the literature,four new expropriation compensation standards have been developed for policy makers and researchers to consider.These innovations were designed to address the low levels of compensation,the practice of offering different amounts for the same land,administrative intervention,and the protection of rights and interests.However,practice and research show that all compensation standards have inherent problems,limiting both access to land requisition compensation practices in specific applications and the desired compensation effect.Through the division of public welfare and commercial land,the different compensation standards were implemented.There is a basic problem:How do we distinguish between public welfare and commercial land? The land price of comprehensive area piece and unified annual output value,in general,are only a transitional form of compensation for land reform.Compensation standard problems of share project benefits are the limitations of the scope of application,the initial capital setting,and decisionmaking participation.Market-based compensation standards are limited by the rural land market.
