研究目的:从经济学和法学的视角探讨集体土地所有权的完全性。研究方法:运用规范分析法和综合分析法,对集体土地所有权的收益权能和处分权能的完全性进行了系统分析。研究结果:(1)集体土地无论是农用还是非农用,其收益权都是完全的;(2)由于集体土地所有权客体的特殊性,国家土地征收权和土地管理权的存在并不构成对集体土地所有权完整性的损害,因而其处分权也是相对完整的。研究结论:由于收益权和处分权是土地所有权最重要的两项权能,它们的完全与否将直接决定着土地所有权的完全性,因此,目前中国集体土地所有权是相对完全的所有权。
The purpose of this paper is to study the completeness of rural collectively-owned land ownership from the perspectives of law and economics. Methods employed include normative and comprehensive analysis. The results indicate that the income fight of the collectively-owned land is totally complete rights regarding either agriculture or non- agriculture; meanwhile, the governmental acquisition fight and administrative right do not harm to the completeness of the collectively-owned land ownership owing to the particularity of the object of the collectively-owned land. Therefore the alteration right of the land is also relatively complete. Because the income right and alteration fight are the most important rishts of land ownership, therefore both of them determine the completeness of land ownership. Given this, the collectively-owned ownership in China is a complete ownership.
