在中国社会主义经济建设过程中,现行法律对有关行政垄断的规制存在诸多缺陷,我国市场经济的发展与法治国家的建设,无不要求对我国现阶段经济建设中盛行的行政垄断予以有效的规制。本文欲建立对包括抽象行政垄断予以规制的行政垄断司法审查制度,并试图予以完善。

There are many defects of the existing legal regulation of administrative monopoly in the process of China＇s so- cialist economic construction, China＇s market economy development and the rule of law in the country＇s construction, all re- quire effective regulation of administrative monopoly prevailing in the current stage of economic construction in China. This article wants to create abstract administrative monopoly to be the regulation of administrative monopoly judicial review sys- tem, and trying to be perfect.
