《中华人民共和国政府信息公开条例》在政府信息公开范围中划定了"主动公开"、"依申请公开"和"不得公开"的三条边界,但据此无法确定政府信息公开主体及其职责分工。"三张清单"具有划定行政机关权责边界的基本内涵,"三张清单"的实施有赖于政府信息公开制度的运作,"三张清单"的属性能够促进政府信息公开主体建设。以"三张清单"制度构建为路径,可以重构政府信息公开主体的"行政职责""必须为"、"行政职权""可以为"和"权力外""不得为"的三条边界,完善我国政府信息公开制度。
The boundary of active publicity, publicity from application and no publicity has been declared in Government Information Publicity Regulations. But the subject and duty of government information publicity can not be defined easily. The ‘three lists' system intends to define the boundary of government agencies' power and duty. The enforcement of the ‘three lists' system is based on government information publicity, and its enforcement can do help define the subject of government information publicity on the other hand. By constructing the ‘three lists' system, we could redefine the boundary of the principles as ‘administrative duty then should do', ‘administrative power then may do' and ‘out of administrative power or duty then shouldn't do' in the subject of government information publicity, and do improve our government information publicity system.
