第三方干预,作为西方冲突化解的一种主要方法,通常是在冲突双方不愿意协商或是谈判陷入僵局之后,为使冲突双方取得某种形式的进展或者在必要的时间范围内获得进展时而采用的冲突化解方法。文章通过对西方冲突化解中第三方干预的系统梳理,阐述包括调解、仲裁、培训和关系治疗等在内的具体干预方法,并揭示其优劣,以期对社会转型期中国公共冲突化解的研究与实践提供借鉴价值。当然,在冲突化解第三方干预实践中,究竟选择何种具体方法,取决于冲突所处的不同阶段及其特定情境,只有用得其所,才能充分发挥其效力。
The third party intervention, as a kind of the main methods in the western conflict resolution, is the method of conflict resolution adopted when both sides are not willing to negotiate or negotiations are deadlocked, so that both sides in the conflict get some progress in the scope of the necessary time by the third party intervention. The paper introduces the third party intervention in the western conf lict resolution, including its specific intervention methods: mediation, arbitration, training and relationship therapy, and reveals their advantages and disadvantages in order to provide some reference values on China's public conf lict resolution researches and practices in the social transition period. However, which kind of specific methods should be chosen in the third party intervention practices, depends on different stages and the specific situation when conflict happens. Only the right way plays their effectiveness enough.
