军民融合是现代国防科技发展的趋势，但是目前的定密与解密制度在一定程度上制约了国防知识产权市场化的发展。国防专利如何定密与解密并向民用市场转化已经成为一个急需解决的重大课题。文章针对国防专利定密与解密现状，分析其存在的主要问题如定密从严、解密从延、定密责任人制度不健全、利益归属不明确等；基于此，提出应对策略，希望能对我国国防专利制度设计和军民融合发展提供参考。

Civil-military integration is the trend of modern national defense science and technology, but the current encryption and decryption system restricts the marketization development of the national defense intellectual property to some extent. How to encrypt and decrypt the national defense patent and transform it to the civilian market is becoming an important problem to be solved. Through the analysis of the current situation of the encryption and decryption of national defense patent, this paper points out the main problems in this respect such as strict encryption, delayed decryption, unsound secret decider system, unclear interest division, etc. On this basis, the PaPers Duts forward some corresponding strategies which are helpful to the design of Chinese national defense patent system and the development of civil-military integration.
