在《侵权责任法》实施的当下,医疗损害责任鉴定逐步取代了医疗事故技术鉴定,对于医疗损害案件应如何监管成为卫生行政部门的重要课题之一。作者根据医疗损害的主要类型,从目前医疗安全监管的内容和法律依据出发,分析了医疗安全监管中存在的主要问题并就如何监管提出建议。

With the implementation of the Tort Liability Law, medical malpractice responsibility appraisal has gradu-ally replaced medical malpractice technical appraisal. How to supervise medical malpractice cases has become one of themost important research topics faced by the Health Administration Department. According to the main types of medical mal-practices and contents and legal basis of the current medical safety supervision, the authors analyzed the main problems inmedical safety supervision and raised suggestions on supervision.
