司法解释有合理性的因素与合法性的根据，但并不意味着司法解释因此就具备了正当性，应当承认现阶段其存在必要性的前提下完善司法解释的体制。两高根据刑事诉讼法对“刑讯逼供等非法方法”的解释与法律本意有出入且两高的解释之间也有冲突之处。从口供的理论基础看，口供的排除应当由主观性标准转变为客观为主、主观为辅的综合性标准。
英文摘要：
Judicial interpretation has the factors of rationality and legitimacy, but does not mean that the judicial interpre- tation therefore have demonstrated the legitimacy. Its existence necessity should be recognized at this stage, and perfect the judicial interpretation system. There are conflicts between their explanation. From the theoretical basis of oral confession, the eliminating rules of confession shall transform from the subjective standard to the comprehensive standard.
