自然灾害的频繁发生、中国—东盟自然灾害领域区域合作的兴起以及灾害防治国际合作法律机制的广泛建立为中国—东盟自然灾害防治法律机制的建立提供了现实基础。在此基础上,中国—东盟建立了软法性的灾害管理合作法律机制。这一机制存在义务责任不明确、没有争端解决机制以及没有法律拘束力的缺陷,这些缺陷不利于实现中国—东盟灾害防治的真正合作。为此,中国—东盟可以通过两条道路实现灾害管理合作的硬法之治。第一条道路是制定《中国—东盟灾害防治合作条约》,另一道路是借鉴《东南亚友好合作条约》模式,中国加入《东盟灾害管理应急协定》。
The frequent occurrence of natural disaster,the rise of international cooperation in the field of natural disaster between China and ASEAN,and the wide establishment of related legal mechanism in the world provide factual demands and legal environment for the establishment of legal mechanism of the international coop-eration for natural disaster prevention and reduction between China and ASEAN.The existing legal framework of Sino -ASEAN shows that the legal mechanism is soft law governance with defects such as liability and responsi-bility unclear,no legal binding and no dispute settlement mechanism,all of which will hinder the realization of their cooperation.Therefore,China and ASEAN can establish hard law mechanism of disaster management with two approaches:one is to enact An Convention between China and ASEAN for the Prevention ofNatural Disasters;the other is to accept The Agreement on Disaster Management ofASEAN by drawing lessons from TAC.
