通过对南京市栖霞区两个小区的小产权房业主的问卷调查,分析小产权房持有群体的特征,揭示小产权房业主的购房行为及利益诉求,从而为政府制定基于保障小产权房业主权益的治理政策提供参考.研究结果表明:由于外地人购买小产权房不办理户口迁移的限制和拆迁安置的原因,小产权房的业主多为南京人尤其是原村集体成员;购买小产权房主要是自住,投资性购房很少,并且交易案例很少;利益驱动是小产权房产生的重要原因;目前小区周边配套较为成熟和完善,采取拆除的处置方式既不符合实际也在经济上不合理;82.47%的业主对小产权房政策了解甚少,且87.62%的人认为合法或者有存在的合理性;83.5%的人支持小产权房转正,如果转正中需要交纳相关税费,土地出让金应该由村集体和开发商来补交,业主只能补交购房时小产权房与商品房的差价,转正后的房产应该能在市场上合法交易.
This paper characterizes the behavior and beneift requirements of homeowners with limited property rights, with the aim of providing policy advice to the government in this regard. Using a questionnaire, the rights and interests of owners in two residential districts of Qixia district were determined. The results show that owners are local citizens and tend to be vilagers with registered residence who are subject to movement and resettlement restrictions. Owners' objectives for buying a house tend to be to provide a home, rather than for investment purposes. The main reason that owners buy houses with limited property rights is beneifts. Infrastructure around residential districts is so dense that it is not practical or economicaly feasible to demolish these houses. Of the owners, 82.5% clearly understand the policies that control houses with limited property rights; 87.6% of owners believe that the existence of these houses is logical and legal; and 83.5% of owners believe that these houses should be legalized and the vilage and developers have duty to contribute to the land transfer fee, while owners should contribute the difference between their home and the price of commercial housing.
