在对当前中国农村土地管理制度中存在的问题进行深入剖析基础上,结合城乡一体化发展的内涵,从制度改革协调联动性、整体性角度出发,设计了农村土地管理制度改革的Land—PPET框架。通过对农村土地产权、规划、征收和流转制度的创新研究,以明晰集体土地所有权、宅基地使用权、农地承包经营权的主体、年限和范围;转变规划理念,科学开展农村土地规划,积极引导多方主体参与规划的编制,有效引导村庄建设发展;提高土地征收补偿标准,严格限定征收范围,完善征地手续,保证征地的公平;有序开展土地流转,探索改革农村住宅用地供地模式,推进农村宅基地确权流转市场化,解决农村土地管理制度中存在的问题,促进城乡一体化发展。
Currently, in the context of urban-rural integration development, land-use issues have become a key factor that impedes the process of Chinese urbanization, and rural land management institution is the core of land-use issues. Based on the analysis of the existing problems in current China' s rural land management system, combined with the connotation of urban-rural integration development, this paper develops a framework of Land-PPET to innovate China' s rural land management institution from the viewpoint of coordinated linkage of institution reform and holistic perspective. Based on the innovative research of land property rights and land planning, acquisition and transfer system, the results indicate that it is necessary to clearly definite the main body, fixed number of years and the range of the collective land ownership right, rural housing land use right, and land contractual management right; to change the planning idea, scientifically carry out rural land use planning, actively guide the multi-participation in planning process, and effectively guide the village construction and development; to improve the land acquisition compensation standards, strictly limit the collection range, improve the land acquisition procedures, and ensure the fairness of land expropriation; to carry out land-use transfer orderly, formulate detailed management rules for the implementation of "one rural homestead one house" policy, and carry out a comprehensive rural land registration work, so as to solve the existing problems in the rural land management system and effectively promote urban-rural integration development in China.
