随着流域生态补偿试点的开展和进行,河北、安徽、贵州、江苏、湖南等地纷纷出台了相应地方立法。这些立法在断面水质考核、补偿方式、补偿资金的计算方式等方面有着较大的相似性,但是在流域生态补偿的内涵、监督管理体制、补偿方式、补偿标准等方面仍存在一些缺陷。后续的立法应主要从明确流域生态补偿的内涵、完善监督管理体制、丰富补偿方式、制定合理的补偿标准等方面作出努力。
With the implementation of the pilot of ecological compensation in river basin in various provinces, the local legislation has been promoted in Hebei, Anhui, Guizhou, Jiangsu and Hunan. All these legislations share great amount of similarity in terms of water quality assessment in fracture surface, compensation means, and calculation of compensation. However, defects occur regarding the compensation connotation, mechanism of supervisory management, compensation means and standards. The subsequent legislation should be upgraded in terms of clarifying its connotation, improving the supervisory management, enriching compensation means and setting up reasonable compensation standard.
