自然资源物权制度关系到合理开发利用自然资源,促进社会主义经济建设的根本大事。然而通过对自然资源物权领域的现实问题考察,发现自然资源利用效率低、浪费严重、环境问题突出、资源价格偏离价值等问题无不凸显出自然资源物权制度的缺陷。深入分析我国自然资源物权制度之缺陷,笔者以为需要革新自然资源物权制度之基本理念,对不同属性自然资源实行侧重不同的物权制度,明确将国家所有者与其管理者身份相区分,真正保障自然资源物权制度体系下的权利人权益。

英文摘要：

The real right system of natural resources is closely related to the reasonable utility and cul-tivation of natural resources as well as to the promotion of socialist economy. Through investigation into the realistic problems, it is discovered that the utility efficiency is low and there is huge waste of natural resources. The environmental problems and the deviation of resources price from the value indicate the de-fects of the real right system of natural resources. This paper proposes that we need to make innovation the basic concepts in it and implement different policies for resources of different natures. The role of state owners and the managers should be clearly differentiated to ensure the interests of the obliged under this system.
