Using 2003-2011 years＇ panel data of China＇s outward foreign direct investments in 58 representative countries or regions, and based on the extension gravity model, the paper studies the effect of legal system quality on China＇s outward foreign direct investment location choice from the aspects such as the degree of legal perfection and the degree of property protection. It finds that the good environment of investment and the protection of private property in the host country or region are an important motive for China＇ s outward foreign direct investment. Some transnational flows of capital are to make use of competitive advantages to obtain high profits, but there are also capital flight operators trying to gain private interests through transferring their capital overseas. The driving role of the domestic legal system is greater than the gravitational pull of the host country （or region）. China＇s outward foreign direct investment is still in the developing stage, and there exists a great blindness in its cross-border capital flows.
