技术标准国际化与专利权的紧密结合是当今知识经济时代的特征之一。通过与传统单件专利权的许可进行对比研究,着重分析了国际标准下专利权的许可特性,指出国际标准下的专利许可问题不单纯是一个法律问题,更是一个以国际标准为媒介,涉及法律、管理、经济等多门学科的问题,其症结在于标准的公有性与专利权私有性之间的矛盾。在分析理论与实际差异的基础上,为我国如何应对提出了相应的建议。
英文摘要：
Technology standards internationalization and patent which are closely are the one of the characteristic of today＇s knowledge economy era. With the traditional one-piece patent licenses comparative study, this paper focus on analysis of international patents licensing under the international standards, pointing out that under the international standards, patents licensing issue is not a simply legal issue, but an international technology standards for the media, involving legal、regulatory、economic and other-discipline problems. The main problem lies with the standards of the public nature of the contradiction between private patent. Based on analyzing the differences between theory and practice, put forward the corresponding suggestion.
