代工企业“血汗现象”是全球化时代发展中国家面临的一个问题。存在“血汗现象”的代工企业的劳工,生存权是没有保障的,健康权也受到了严重威胁,自由权被剥夺。代工企业“血汗现象”是一些发展中国家的政府压制工会和剥夺工人集体谈判权的产物,也是发展中国家的一些地方政府庇护和偏袒跨国资本以及司法系统劳工权利保护和救济不力的结果。治理代工企业“血汗现象”,要强化政府的公共责任,保障劳工的集体谈判权,解决发展中国家之间以及发展中国家内部为吸引外资的“逐底竞争”难题。
"Sweat Phenomenon" in the OEM is a problem that the developing countries are facing in the era of globalization. The labours in the sweatshop have no survival rights, their rights to health have been badly threatened and their liberties have been deprived. The growth of "Sweat Phenomenon" in the OEM is because the government in some developing countries inhibits the trade union and deprives the workers' right of collective bargaining and some local governments in the de- veloping countries favor the transnational capital, and because the judicial system can not protect the labours' rights. In order to govern "Sweat Phenomenon" in the OEM, we must let the government take their public responsibility, protect the labours' right of collective bargaining, and solve the problem of "race to the bottom" among the developing countries and in the developing countries for attracting foreign capital.
