Intellectual property rights are an artificial creation, its essence is a kind of policy measures, its ultimate aim is to improve the social welfare of consumers, if the exercise of intellectual property rights in contravention of such requirement has been abused, we should regulate it to prevent it from being abused. This paper is divided into the following sections： firstly, it analyzes international conventions on the abuse of intellectual property rights; secondly, it analyzes other countries in the world the abuse of the legal regulations of intellectual property rights; Finally, it analyzes the status of China＇s legal regulation about the abuse of intellectual property rights and its legal perfection.
