This paper discusses the three kinds of patent strategy of enterprises based on ex-post rewards theory： i） enterprises apply patent after completing a invention in order to get technology mo- nopoly and monopoly profits; ii） enterprises execute ex-post rewards policy to compensate inventions profit due to no patent application;ill） based on applying patent and ex-post rewards, it use the case a- bout China Environmental Project Tech Inc charging HuaYang company and Japan Fuji water corporation infringement to analyze relation and difference between the ex-post rewards policy and patent protection. This paper finally concludes with suitable enterprise patent strategy.
