Criminal Law of Jinshu present several hot debates about the existence or abolishment of the Corporal punishement.Its historical background as well as the progress of the society determined that the Corporal punishment is bound to be abolished. Because of the imperfection system of punishment and the Legalists thoughts＇ renaissance,the abolished punishment caused debate once again.The abolishment of Death penalty cause a long time discussion in the jurisprudential circle.The hot debate happened thousand years ago gives useful enlightenment for the abolition of the Death penalty contemporarily.Only if we find the appropriate punishment and gain a solid mass base,can we smooth out the road to abolish the Death penalty.
