经过三十余年的研究和论证,中国刑事法学界并没有呈现出对“两少一宽”刑事政策的认识趋同。相反,基于国家对其在规范和解释上的沉默,至今不但没有形成统一观点,且分歧似有扩大之势。这就需要对“两少一宽”刑事政策进行重新审视和反思,以求超越现有对“两少一宽”刑事政策的认知,找到“两少一宽”刑事政策的历史进路。
For more than 30 years of research and argumentation in Chinese criminal law community, no consensus has been reached about the criminal policy of "fewer arrests or death penalties, more leniencies". On the contrary, disagreement seems to be widening due to official silence on the regulation and interpretation of the policy. As a result, it is necessary to make new examinations and reflections on the policy so as to go beyond existing knowledge and find out a new historical approach to the criminal policy.
