随着经济的快速发展以及法制社会的逐步建成,突发事件呈现新的特点,粗放式的应急处置导致了新的衍生风险,如何本地化应用法律,依法处理突发事件防范衍生事件发生成为应急管理的关键。本文首先梳理了国内突发事件应急处置流程的法律体系,而后选择北京市某核心区进行应用,针对应急事件分级、现场处置指挥权限混乱等应急处置问题,提出了“上下级事件分级保持一致”、“先期处置”、“先期处置指挥官制度”、“环卫应急力量”和“信息共享防范衍生事件”等策略,应急法律的本地化为管理人员提供了帮助。

With the rapid development of economic and gradually build of social legal system, emergencies showed new features, extensive emergency handing resulted in new derivative risk. It has become the key of the emergency management to according to prevent the derivative incident when dealing with emergencies under the frame of law. Firstly, this paper reviews the domestic and foreign legal system of emergency disposal process, and then chooses a core area of Beijing City as an example. According to the emergency event classification, the scene disposal command authority confusion and other emergency disposal problems, the strategy such as ＂same event classification within upper and lower departments＂, ＂early stage disposition＂, ＂early stage disposition commander system＂, ＂sanitation emergency power＂ and information ＂sharing derivatives to prevent the derivative event＂ were established. The localization of emergency law provided obvious help for emergency management personnel.
