农村集体建设用地使用权萌芽于人民公社时期,形成于改革开放初期,一直在随着农村现代化进程的发展而不断推进与完善,1998年以后的农村建设用地使用权流转试点已经为我国的土地立法积累了充足的地方实践经验。《物权法》、《土地管理法》等相关法律的修改必须在总结农村集体建设用地使用权建设经验的基础上,建立起适用城乡统筹发展的农村集体建设用地使用权制度。
The right of use of rural constructional land began at People's Commune period, formed at the initial stages of reform and opening-up period, developed and completed at the rural modernization. Since 1998, the experimental unit of the right of use of rural constructional land transfer has accumulated sufficient practical experiences on Chinese rural land legislation. The amendment of some relevant laws like property law, land management law should consult the experiences of the right of use rural constructional land in order to establish a system which can balance rural and urban development.
