本文以中国1985--2009年问风能和太阳能领域的发明专利作为研究对象,使用专利权延续时间长度作为专利质量的衡量指标,研究了中外研发单位间,以及中国本土各类研发单位专利质量的差异.结果显示:中国与外国申请人的专利质量存在较大差距;在中国本土各类研发单位中,企业申请的专利拥有较高的质量,个人申请的专利质量水平尽管不如企业,但与中国研究机构并不存在显著差异.本文还使用参数生存分析模型对专利质量的影响因素进行了回归分析,结果显示:研发单位拥有较大的研发规模有助于专利质量的提高,这说明技术含量高的专利更容易产生于大型企业中;尽管在风能领域作用不显著,但单位间进行合作研发显然有助于提高太阳能领域专利质量.
Taking invention patents of China in wind and solar energy fields from 1985 to 2009 as the samples, and u- sing the term of patent right as the measurement of patent quality, it makes a comparison study on the quality between domestic and foreign patent applicants and among different types of Chinese applicants. The result shows that there is a large gap in patent quality between domestic and foreign patent applicants. Among all the Chinese applicants, patents filed by corporations command higher quality; individual patents possess lower quality than those filed by corporations, but not lower than those filed by research institutes. Then it makes a regression analysis on the determinants of patent quality by using parametric survival model. The result shows that those with larger R&D scale promote higher patent quality, which suggests that patents with higher level technology are more likely to be invented by larger firms. Al- though the joint research between research units does not affect patent quality in wind energy, it is beneficial to impro- ving patent quality in solar energy.
