地方政府守信利民有着坚实的法理基础。地方政府信用缺失不仅影响我国经济社会的健康发展,而且还侵蚀着政府的合法性。在影响地方政府信用水平的众多因素中,地方政府信用法律体系建设的严重滞后是造成当前我国地方政府信用缺失的重要因素。目前,我国法律中涉及政府信用的原则主要是人民监督、依法行政、政府赔偿和信息公开,而这些法律制度远不能有效地促进我国地方政府信用建设。因此,本文在分析政府信用内涵及其法理依据的基础上,提出了我国地方政府信用法律体系建设的基本框架,即地方政府信用征信法律体系、地方政府信用评估法律体系、地方政府信用监管法律体系和地方政府信用惩罚法律体系。
