随着农村集体经济发展和人口的流动,集体经济组织边界模糊的现象越来越普遍。从基层社区的实践出发,调研广东汕头市信宁村、赤隆村和揭阳市梅兜村三个村,深入调查村民资格和集体经济组织成员资格的认定标准。从调查结果来看,"户口是否在农村、是否是农业户口和是否长期居住在农村"成为认定集体经济组织成员资格的主要标准。成员权认定嵌入社会关系中,除国家法律和政策逻辑外,还受到村民乡土逻辑的影响。因此,政府应该转向如何调节和处理村民、成员与集体经济组织的关系,而不能自上而下统一干预和规定成员权的认定标准。
With the development of rural collective economy and growing of floating population,the boundary of Rural Collective Economic Organization( RCEO) becomes increasingly fuzzy. This paper,based on the practical logic of rural community and the survey of three villages in Guangdong Province,discusses the standard on how to identify the membership of villager and RCEO.Investigation result shows that the standards which local people hold,namely,whether a person is a rural registered resident,whether he / she is an agricultural registered resident and whether he / she has lived in the village for a long time,are the major standards to identify the membership of RCEO.In other words,the right to being one member of RCEO is not only determined by the logic of national laws and policies but also by the practical logic of villagers.Therefore,government should deal with the relationship among villagers,RCEO and their members,instead of qualifying standard of being one member of RCEO.
