近年来，随着贸易的发展，知识产权许可交易中发生的法律纠纷越来越多。其中，由于无效知识产权导致的法律纠纷占有较大比重。而学术界对此展开的研究目前还不多见。本文研究了无效知识产权许可几种起因。并通过比较中美两国立法的方式探讨了由此引发的相关法律问题。
英文摘要：
With the development of trade, there is a increase on law cases of intellectual property rights licensing in the recent years. A large proportion of these cases are due to invalidation of intellectual property rights, However , no enough attention is paid on this area by academe. This paper aims to analyze the reasons leading to invalid intellectual property rights and the related legal problems in a way of contrasting the legislation of China and USA.
