2013年中央一号文件提出拟用五年确权颁证登记以来,全国确权工作取得了很大成绩,但同时也产生了不少纠纷。农地确权问题的根源在于没有形成一个清晰的基于农地产权主体及产权可流动性的确权逻辑。本文通过＂集体-农户＂分析范式和农地产权二元主体的历史演变对农地集体和农户的产权模糊性及流动性进行分析,力图构建一个解决＂三权分置＂下农地确权工作困境的确权逻辑。

It was set forth in the 2013 No. 1 Document of the CPC Central Committee that five years would be used for land right confirmation and registration,the work of land right confirmation has made great achievements,but also caused some disputes. The origin of problems in right confirmation of agricultural land lies in the lack of a definite logic for land right confirmation based on the subject of agricultural land right and the mobility of land property right. This paper,based on the ＂collective- peasant household＂analytical paradigm and the historical evolution of dual subjects of agricultural land rights,analyzes the ambiguity of the collective and peasants＇ rights of agricultural land,attempting to bring forward a right confirmation logic for solving the dilemma of agricultural land right confirmation under the precondition of ＂three- right separation＂.
