互联网教育是未来教育的重要形态,是教育变革的重要推动力量。随着互联网技术及其应用的快速发展,互联网教育呈现出新的特点,也凸显出新的问题,这都迫切要求我国进一步加强和完善与互联网教育相关的法律和政策法规。当前国外对互联网教育的立法重点主要聚焦在教育资源版权保护、个人隐私和信息安全、传播内容规范等方面,而我国在互联网教育立法方面仍存在法律法规和政策体系滞后且不够完善等缺陷。未来我国互联网教育立法或可沿着两条路径推进:一是在立法资源有限的情况下,在与互联网教育相关领域(如教育、互联网信息、文化传播等)的法律条款中与时俱进地增加推动互联网教育发展的内容,或以条款的方式作出规定;二是教育部门从推动互联网教育发展的内容框架(如顶层设计、实践操作和保障体系等)层面出台相关规章、细则或办法。当然,这些建议仅是从互联网教育发展的内容框架等方面提出,进一步研究还需要从规范的法律条文的角度去探索。
Internet education is an important form of future education and is also a significant driving force foreducational revolution. With the rapid growth of the internet technologies and corresponding applications, theinternet education presents new characteristics while brings new problems, all of which require for furtherstrengthening and perfection of the laws, policies and regulations related to the internet education. At present,international researches on the internet education legislation focus on the protection of copyright of educationalresources, individual privacy, information safety and normalization of information and so on. However, the laws,regulations and policies in China’s internet education legislation are not completed. In the future, China’s interneteducation legislation can be propelled through two routes: the first one is to add contents which propel the interneteducation development simultaneously in laws and regulations of fields related to internet education(such aseducation, internet information, cultural communication and so on), or enact rules in form of terms; the second one isabout suggestions for the educational department to publish related regulations, detailed rules or regulations fromthe frameworks for internet education development(such as top-level design, practical operation and securitysystem and so on). Definitely, these suggestions are brought out from the framework of internet educationdevelopment and further research should be conducted from the perspective of standard laws and clauses.
