At present , there is still not a unified mental hygien law in China , so no relevant law codes are available for regu- lating the practices of appraisers in the appraising process. Due to various reasons, sometimes there are ＂artificial sex identifies a fault＂appear in the identify and cause the case that the person whose mind is ok to closed in the hospital often appear. The paper will make a concrete analysis of the cause of this phenomena and the irregularity of misfeasance, and bring forward personal views on how to eliminate this phenomena. So as to get inspiration from it for establishing ＂Mental health law＂ in the future.
