The protection of intellectual property rights has been the important factors that impact SMEs＇ （small and medium enterprises） development. Through establishing the game model, we derived the external factors that impact SMEs＇ behavior in protecting and violating the intellectual property rights, including the cost of intellectual property rights＇ declaration and maintenance, the fine level for violation behavior, as well as the cost of piracy. From the perspective of intellectual property rights legislation, this paper analyses how to improve these external factors, and create a favorable external environment for SMEs.
