同所有开放存取数字资源一样，机构知识库在开放存取利用中也存在知识产权保护及其管理等问题。美国学术机构知识库的开放存取活动开展的比较早，而且运行机制比较完善，文章对美国麻省理工学院、美国加州大学、中国科学院、厦门大学、清华大学等机构知识库建设中的适用法律、权益分配、责任义务及运行机制等法律问题进行比较。以期借鉴。

As with all the open access digital resources, the institutional repository also has problems of intellectual property protection and management in the use of open access. The open access activities of the United States academic institutional reposito- ry are carried out relatively early and the operating mechanism is relatively perfect. This paper compares the applicable law, distri- bution of rights and interests, responsibilities and operating mechanism in the construction of institutional repository of the Massa- chusetts Institute of Technology, University of California, Chinese Academy of Sciences, Xiamen University and Tsinghua University to reference.
