Toulmin＇ s model of the argument in the legal aspects of application has extensive significance. Toulmin＇ s model and its argument about constitute factors are analyzed. Toulmin＇ s argument model includes claim, proof, guarantee, support, rebuttal and modal qualifier. Claim is the starting point of the argument. The type of claim determines proof. Guarantee is needed from proof to claim. When the reliabilities and correlations of guarantee were challenged, we need to seek for different types of support. Considering the exception, rebuttal may be needed. The final statement inevitably needs modal qualifier.
