我国推行招投标制度20多年以来，建筑市场的竞争逐步走向规范化、法制化、有序化的轨道。然而，工程招投标中的围标和陪标行为严重影响了建筑市场的公平竞争，给招标人带来经济损失，并扰乱建筑市场秩序，解决围标和陪标问题已刻不容缓。本文从投标人之间的围标和陪标问题出发，首先介绍了围标和陪标的概念、成因以及危害，阐述了围标和陪标行为的整个过程；然后结合博弈论的相关知识，建立了招投标中围标和陪标行为的博弈模型；并从各经济变量与围标和陪标预期收益之间的关系人手，分析了如何减弱投标人的围标和陪标欲望、打破投标人之间的串谋；最后根据模型分析结果，从社会治安、法治、管理体制和监督等方面提出了针对围标和陪标问题的防范措施。
英文摘要：
The competitions in the construction industry have become more and more regulated,legalized and systematized since the bidding system was implemented more than 20 years in China. Surround-bidding and accompanying-bidding in project tender and bidding process,however,influence the fair competition seriously in construction industry. They bring economic losses to the tender and disrupt construction industry order. It is urgent to solve the conspiracy issues. This paper starts from the surround-bidding and accompanying-bidding issues among bidders, firstly introduces their concept, causes and hazards, followed by a description of the entire conspiracy process. Then it establishes the game model in tender and bidding makes an analysis of weakening the bidders＇ desire for process, combined with some knowledge of game theory. It surround-bidding and accompanying-bidding to break the conspiracy among bidders, based on the relationship between various economic variables and the expected proceeds of the conspiracy. Finally the prevention measures in the light of surround-bidding and accompanying-bidding issues are proposed , according to social security,legal system, management system and supervision, etc
