海峡两岸投资争端解决机制的制度创设和规范设计,既需要在根本上推动两岸授权协商的深化与突破,又需要对于现行纠纷化解轨道加以整合和持续探索。其中尤其需要基于立法政策学的自觉立场、系统思维和实效指向,以适用性为旨趣和归依,破除不同争端解决机制各自程序环节的自足性。因此,在《海峡两岸投资保护和促进协议》构建的格局下,应当不局限于已有的纠纷解决机制途径的各自独立性和相对完整性,可以合理审慎地借鉴英国金融消费纠纷解决中富有特色的评议裁处制度的设置理念,强化纠纷解决机制及其项下程序环节的协同性、渗透性,在行政机构与商会组织协同开展的争端解决环节吸纳评议裁处制度的适宜因素,以之推进海峡两岸投资争端解决机制的开放化发展、精细化演进和有效化操作。
The design and construction of the cross-strait investment-dispute resolution mechanism needs more cooperation between the Mainland of China and Taiwan of China and the improvement of the existing means, including the more workable arbitration legislation and policies, new approaches, and clear purposes. Under the guidance of the Cross-strait Investment Protection and Promotion Agreement, it is necessary to integrate the existing dispute resolution means, learn from other coun- tries" experience like that in Great Britain, especially the merits in their arbitration legislation and the related system, which can help quicken the design and construction of the cross-strait investment-dispute resolution mechanism and improve its efficiency.
