文化差异可能存在于国际商事调解的全过程。为了探究文化差异在国际商事调解中的表现及影响,采用比较研究的方法,主要通过研究东西方文化在调解中的差异得出以下结论:受调解中当事人主导特性的影响,文化差异影响到国际商事调解中当事人对争议的态度、争议解决的价值取向、面子观、思维和决策模式、表达利益要求的方式、调解中的沟通模式等各个方面,它会给国际商事调解造成很大障碍,所以应妥善处理国际商事调解中存在的文化差异。
Cultural difference may be very common in the process of international commercial mediation due to the party - oriented character of mediation procedure. By comparing between the eastern and western cultures during the process of international commercial mediation, the cultural differences in international commercial mediation was focused;cultural difference may influence the whole process of each mediation process by the parties' different views of dispute, different motivation to join in the procedure, different needs for " face", different ways of decision - making and various ways of expressing their standpoints, etc. All these differences may prevent the mediation process from going forward. Whether a mediation agreement will come out depend, in some degree, on how the mediatom would deal with the cultural differences in the whole process.
