本文首次聚焦于专利侵权诉讼,以2006—2014年A股非金融企业为样本,考查专利权诉讼的提起、判决以及审理时长等诉讼细节对原被告企业创新活动的影响。研究发现:(1)专利侵权诉讼对原被告双方的企业创新都有激励作用。但对原告样本进行细分后发现:诉讼会对行业领导者的研发决策产生促进作用,但对行业追随者会产生抑制作用;(2)行业领导者的研发活动不受判决结果的影响,而行业追随者和被告都会根据诉讼结果对研发投资进行调整;(3)审判时长并不影响被告的研发决策,但是会对原告尤其是行业追随者产生负面影响。本文不仅揭示了司法诉讼对原被告创新活动的影响机理,同时也为企业解决专利权纠纷的途径选择提供了参考依据。
Using a sample of non - financial public finns in China, we investigate the impact of patent litigation on plaintiff finns' and defendant firms' innovation. Specifically, we want to reveal how prosecutions, judgments and trial lengths of patent litigation influence innovative activities. The results are: ( 1 ) The charge of patent litigation will enhance innovation for both sides of lawsuits, Furthermore, when dividing plaintiff finns into industry leaders and industry followers, we find patent litigation will spur industry leaders' innovation while impede industry followers' innovate activities. (2) Industry leaders do not change their R&D investments regardless of winning or losing. However, industry followers and defendant finns will Significantly increase or decrease R&D investments according to the judgments of lawsuits. (3) Trim lengths do not affect defendant finns' innovation, but they will stifle plaintiff finns' innovative activities. This negative effect is particularly significant for industry followers. Our research not only reveals how and in which mechanism patent litigation affects finns' innovation, but also provides references when finns consider choosing fayorable paths to solve patent disputes.
