国内政府投资项爵代建制推行过程中,未能形成合理的代建管理服务取费标准,严重影响了代建企业参与代建市场的积极性以及良性代建市场的培育。文章针对当前代建服务取费不合理的问题,考虑政府委托人和代建人的风险态度,从风险分担的视角建立代建服务取费模型,在此基础上提出固定报酬和风险报酬两种报酬方案,在两种方案下形成代建服务报酬激励机制。固定报酬方案下,通过确定影响代建服务价格的基准价、费率、调整系数三个核心要素形成服务价格,并设置里程碑事件、履约担保等实现对代建人的激励和约束;风险报酬方案下,根据风险因素对于服务价格的影响途径,从成本、工期、安全和质量等方面进行激励合同条款设置,形成对代建人的激励。
In the implementation process of the agent construction system for the domestic government investment projects, the enthusiasm of the construction agent and the cultivation of a virtuous agent construction market are severely affected due to the failure in forming a reasonable service fee standard. Aiming at solving the problem, the paper established an agent construction service fee model considering the risk attitudes both of the client and the construction agent from the perspective of risk-sharing. According to this model, the paper proposed two programs which are fixed reward scheme and risk reward scheme. Furthermore, under the fixed reward scheme, determined the service price through reasonable defining the base price, fee rate and adjustment coefficients of the price of the construction service, and then achieved the goal of motivating construction agent by setting milestone events and performance security. On the other hand, under the risk reward scheme, the goal of motivating construction agent can be achieved through setting contract terms from the aspects of cost, time safety and quality according to the ways that the risk factors affect the price.
