依据99版FIDIC土木施工合同,首先,解构拖期赔偿费的费用构成,将其分为直接损失费和间接损失费;其次,明确拖期赔偿费的计算范围,并提供拖期赔偿费计算方法;最后,通过对FIDIC合同条件中业主索赔程序和索赔流程进行梳理,归纳出索赔流程图,为业主进行拖期赔偿费索赔提供参考。
Based on FIDIC construction contracts,the paper firstly divide delay damage cost into direct damage and consequential damage. Secondly,it explicit the range of calculating for delay damage cost to provide computing method of it. Lastly,through analyzing the procedure and process of claims for owner,it get the flowchart of delay damage cost for owner to use in a reasonable claim process.
