运用法经济学理论,通过法律的需求分析、法律的成本与收益分析表明:农村集体建设用地使用权流转改革具有较强的现实需求,改革的收益远大于其成本,农村集体建设用地使用权流转改革具有现实合理性。提出修改完善相关法律法规、建立农村集体建设用地流转市场、构建合理的收益分配机制等政策建议。
Based on the law and economic theories, the law analysis of supply-demand and income-cost shows that the right and use transfer of collective construction land is reasonable and needed, for the income of reform is much bigger than the cost. Hence the realistic justification of reform. Some suggestions on the right and use transfer of collective construction land were put forward, perfection of laws and regulations, founding of markets and income distribution system.
