＂Custom and rule＂ is adopted in policy Jaw and system for social stability,and also in judicial process.With this principle,judiciary is not the aim but social stability.During Qing dynasty,the key was not to use judicial right but how to keep social stability through it,the administration tried to treat equally without discrimination but neglected the problem of treating everyone equally,the success and failure of it deserves serious consideration.
