中国的地方司法权,是由其内在逻辑支撑的。基于一切权力属于人民的政治信念.通过人民代表大会制度赋予地方司法机关相应法定的司法职权;中央与地方之间、地方相互之间事权不清,是导致司法职权边界的模糊和实践中地方司法权不稳定的根源,伴随着事权体制的改革,这一问题终将会被解决;我国政治体制的特点以及地域辽阔的现实,决定了地方性差异将长期存在,区域之间的比较与竞争也将长期存在。厘清中央与地方之间的事权关系,合理确定中央与地方、地方之间司法权的权限范围,也是重要的司法改革任务。司法改革应有助于发挥地方在公正司法中的积极作用,而不是简单地“去地方化”。
Local judicial power in China is supported by its internal logic. Based on the politi- cal belief that all power belongs to the people, the system of people' s congress assigns the corre- sponding statutory jurisdiction to local people' s courts. The allocation of authorities between central and local state organs is unclear, and the allocation of authorities between local state organs is un- clear, which result in the instability and vagueness of local judicial power in practice. With the re- form of the division of powers of state organs, this issue will eventually be resolved. The characteris- tics of China' s political system and the reality of China' s vast territory, determine the local disparity will exist for a long time. Simultaneously, regional comparison and competition will exist for a long time as well. It is also an important judicial reform task to clarify the relationship between the divi- sion of powers of central and local state organs and reasonably to determine the scope of jurisdiction of the judicial power between central and local state organs, between local state organs. Judicial re- form should contribute to that local state organs play a positive role in fair justice rather than simply remove ‘the judicial localization'.
