在大气污染联防联治的过程中,以立法的协调促进各省市治理大气污染的合作是有效治理大气污染的方式,立法协调机制的建立不仅是必要的而且是可行的。我们应借《大气污染防治行动计划》的颁布与《环境保护法》修订的契机,汲取美国、日本、欧盟立法协调机制的经验教训,结合我国大气污染联防联治立法的现状。构建与我国国情及法制现状相适应的立法协调机制。建议全国人大及其常委会向国务院授权,由国务院实现立法协调机制法律关系中纵向管理关系与横向协调关系的统一,并构建救济机制。同时,对大气污染治理的生态补偿机制、信息公开和交流制度等配套制度的完善提出建议,旨在对保障立法协调机制的有效运行有所裨益。
In the process of air joint prevention and control, it is an effective way to control air pollution through legislation coordination of various provinces and cities. It is necessary and feasible to establish legislation coordination mechanism. We will take the opportunity that the enactment of Plan of action for prevention and control of atmospheric pollution and the revising of environmental protection law. Learning from the USA State, Japan and the European Union Legis- lation and administrative agreement system, combining with the status of atmospheric pollution in China. Developing the Legislative Coordination Mechanism fit into China' s national conditions and legal status. We put forward the suggestions that through the authorization from the National People' s Congress and its standing committee to the State Council, to achieve that the unity of op- posites between the vertical management relations and coordination in the legislation coordination mechanism of legal relationship by the State Council, and building the relief mechanism. At the same time, through the ecological compensation mechanism, information disclosure, and the improvement of the communication system and other supporting system to ensure the the legislative coordination mechanism will run well during air pollution control.
