法治不同于法制,法治以法制为基础,是法制的精神层面、法制的目标,也是法制要达到的一种结果。法治教育本质上是一种文化教育,它需要精神文化来引领,制度文化来约束,物质文化和行为文化来保障。当中国由法制教育进入到法治教育阶段时,高等教育却仍停留在法制教育阶段,法治教育重视程度不够,机制不健全,课堂主渠道作用发挥不突出,仍处于低水平徘徊阶段。大学生法治教育要脱离低水平循环怪圈、增强法治教育实效,唯有上升到大学文化层面,审视高等学校的法治教育问题,强化法治教育的顶层设计,以大学文化凝练法治教育内容,健全教育制度,完善教育保障,从内而外,全方位推进法治教育,才能取得法治教育应有的实效。
The rule of law is different from the system of law in the fact that the rule of law is based on the system of law, embodies the spirit of the system of law, is the goal of the system of law, and is the achievement the system of law is meant to achieve. The rule-of-law education, essentially, is cultural education because it needs to be led by spiritual culture, constrained by system culture, and guaranteed by material and behavioral culture. When Cbina's higher education has developed to the stage in which the system-of-law education urgently needs to be replaced by the rule-of-law education, however, it still stays in the stage of the system-of-law education: the rule-of-law education fails to be fully stressed; the mechanism for the rule-of-law education is imperfect; and classroom fails to play a prominent role in the rule-of-law education as main channel but still stays at a low level. The only way for the collegiate rule-of-law education to break away from the present low level and enhance its effectiveness is promote the rule-of-law education to the level of collegiate culture and think about the collegiate rule-of-law education in the perspective of culture, strengthen the top-level design of the rule-of-law education, enrich/refine the content of the rule-of-law education, and make educational systems sound, complete security measures for the rule-of-law education; that is to say, the rule-of-law education should be promoted from the inside to the outside, namely, comprehensively.
